Array-ne Stock Tickers: NSC, CSX, BNI, UPS, FDX, JBHT, YRCW, BA, RAILToday, it was Norfolk Southern (NSC) that hurt the transports. Norfolk Southern (NSC) is down 9% today at 1.17 after its sh.03 miss when it reported EPS at sh.89.Would transports be lower today if Cramer didn’t say that CSX (CSX) was now a Secular stock rather than a cyclical?

-ne On Monday we were questioning WHY shareholders would accept such a low price on this HCA (HCA) buyout. HCA’s founder-led group does have the right to match any competing bids and there is a 00 million break-up fee. With this being the largest version of legal insider trading you can possibly imagine, what does this tell you about the value of the hospital group if the largest one out there is up for grabs at low multiples?

-ne No one really believes that the management of GM wants to set up a three way partnership with Renault and Nissan. A cash infusion from Renault and Nissan would certainly make it more difficult to convince the UAW that GM is struggling and needs more concessions from the big union. But, Ghosn has shot himself in the foot.

It reported EPS at .97, which up from the .76 EPS number last year but lower than the .21 EPS estimate.

A look at the table to the right, which presents the year/year change in shipments, orders, inventories and backlog shows that something interesting may be going on.Shipments have been poking along at barely above last year’s numbers (and actually below last year in June.) The lag from orders to shipments can be extended in aircraft (less so for parts) so the decline in orders from April was a predecessor to June’s decline in shipments.

Bryan Lafond’s costume at a Hampton Academy Junior High School dance in Hampton, N.H., last Friday was inappropriate for a dress-up dance, said Superintendent James Gaylord, who denied any connection to religious concerns, the Manchester Union-Leader reported. One reason there’s so much talk about gay marriage is that many people believe that traditional marriage, that is, one man married to one woman for life, has failed. Proverbs 30:18-19 The way of a man with a maid, that is, marriage, is so wonderful that one of the wisest man who ever lived, could not describe it. Marriage should be wonderful, this man is so glad to be coming home to be with his wife that he’s skipping: The voice of my beloved! Song of Solomon 5:8 God says that marriage should be wonderful. God created men and women so that marriages should work: Whoso findeth a wife findeth a good thing, and obtaineth favor of the Lord. Proverbs 31:28 God teaches that men are supposed to praise their wives. Ecclesiastes 2:1-11 Solomon tried it all, he found that there’s nothing you can do to make yourself happy, with one exception, and that’s marriage: Live joyfully with the wife whom thou lovest all the days of the life of thy vanity, which he hath given thee under the sun, all the days of thy vanity: for that is thy portion in this life, and in thy labor which thou takest under the sun. That’s Mere Logic God wants marriage to be joyful, but that’s a mere fact. By the time people are unhappy enough to talk to you about marriage trouble, they’re usually too emotional to care what God says. After you give scripture about God designing marriage to be a blessing, ask about good times in their marriage. Ignore problems for the moment: There hath no temptation taken you but such as is common to man: but God is faithful, who will not suffer you to be tempted above that ye are able; 10:13 No matter how bad the marriage seems, no matter how strong the temptation to divorce, God promises a way to escape! There are two false gods worshipped in our land: the bully god and the buddy god. A man who thinks god’s a bully tends to bully his wife no matter how she tries to please him, a woman who believes in the bully god thinks her husband’s bullying her no matter how he tries to nourish and cherish her. God wants us to choose to follow Him out of love as He wants husband and wife to serve each other out of love. You have to get past the emotion caused by frustration in marriage and shift the focus to praising God for the good times and for His grace and goodness. How to be happy in marriage God didn’t just want happy marriages, He also told us how to do it. God says marriage should work, the bride and groom want it to work. God said a great deal about marriage but people aren’t being taught how to be married. That’s why you have to show that God intended marriage to be a blessing. God wants all marriages to be good, you and your spouse wanted your marriage to be good, you’ve had good times, but you say it’s not working. When something’s wrong with your body, you ask the doctor to help you fix it, you don’t throw it away, but lots of people throw marriages away even though that’s not God’s will: God setteth the solitary in families: he bringeth out those which are bound with chains: but the rebellious dwell in a dry land. There’s joy for the husband and wife, but God planned families primarily as a safe place for children to grow up in the nurture and admonition of the Lord. It’s better to fix the marriage you’ve got than to rebel against God, but when a marriage is in trouble, the couple needs help to get back on God’s path. How Marriage Works To understand how marriage works, let’s see how marriage began: And the LORD God took the man, and put him into the garden of Eden to dress it and to keep it. And the LORD God commanded the man, saying, Of every tree of the garden thou mayest freely eat: but of the tree of the knowledge of good and evil, thou shalt not eat of it: for in the day that thou eatest thereof thou shalt surely die. And the LORD God said, It is not good that the man should be alone; and the rib, which the LORD God had taken from man, made he a woman, and brought her unto the man. First, God gave Adam a job before He gave him a wife. No, God recognized Adam’s need and gave him a wife. Did God owe Adam a wife? No, God owes no man. Everybody knows a wife is a gift of God. Wives aren’t earned, wives are given as gifts from God: Whoso findeth a wife findeth a good thing, and obtaineth favor of the Lord. Proverbs 19:14b Many women feel it’s politically incorrect to belong to a man, but the wife in the Song of Solomon says twice "I am my beloved’s" For ye are bought with a price: therefore glorify God in your body, and in your spirit, which are God’s. If you belong to God, women, shouldn’t it be OK with you for God to give you to your husbands? God created women to be wives: For the man is not of the woman; I Corinthians 11:8-9 This verse has been twisted to say that a husband should command his wife, but that’s wrong, God wants a husband to nourish, cherish, and love his wife as Christ cares for the church. God created a wife for her husband, he’s not created for her, so she’ll know him better than he knows her, she’ll care more about pleasing him than he cares about pleasing her, she’ll understand him better than he understands her but he has to try. The wife doesn’t take a husband, the husband takes a wife, but he’s to open his heart to her, hear what she has to say, and take her in honor, commitment, and sanctification, as we’ll see later. A man’s not worthy of his wife’s submission, she’s not worthy of his nourishing and cherishing her, marriage is a gift of God by grace, just like salvation. Marriage prospers when a man treats his wife as God’s gracious gift to him and she acts as God’s gracious gift to him, but there are details you’ll have to teach. Matthew 7:8-11 God gives gifts as parents give gifts. The Bible teaches that a wife is a gift of God, women are made for men. It should be no surprise that the Bible also teaches many conditions God attaches when He gives a woman to a man to be his wife. As for learning from my wife, God commands husbands listen to their wives and act on what their wives tell them: Likewise, ye husbands, dwell with them according to knowledge, giving honor unto the wife, as unto the weaker vessel, and as being heirs together of the grace of life; God is serious about telling you to listen to your wife. Salvation is a gift of God, guys, but you must receive it God’s way or you won’t get the blessing, you can’t earn it. A wife is a gift of God, guys, but you must teach other men to receive their wives God’s way or they won’t get the blessing, a man can’t earn it. God doesn’t expect a man to understand his wife, He expects him to know her. women need huge amounts of praise because God did a super job designing their emotions so that they need praise from their husbands. Men, women are different from you, a man must let his wife teach him how to praise her, that’s part of dwelling with her according to knowledge of her. I know of no other passages where a wife criticizes her husband and I know of nowhere in the entire Bible where a man criticizes his wife, if you find any, please tell me. Praise, gratitude, sanctification, love, longsuffering, and honor are fruits of the spirit which a man must give his wife. No, you don’t, your wife is a gift of God, given you as a favor from God: Whoso findeth a wife findeth a good thing, and obtaineth favor of the Lord. You don’t deserve a wife any more than you deserve salvation, she’s a gift from God. Commands to Women We’ve seen how God expects a man to appreciate his wife as God’s gift, which requires that he praise her and talk to her so that he can live with her based on knowledge of her needs. Abraham didn’t just accept what God said, he bargained with God about how many saved people it would take to save Sodom and Moses asked God not to destroy the Jews in the desert. The Bible says, And the LORD God said, It is not good that the man should be alone; Genesis 2:18 God did not say, "it is not good that the man should have unfulfilled desires," God said, "It is not good that the man should be alone." The Bible suggests that talking is more important to God than taking, but the man thinks that once he’s married, it’s a done deal and he doesn’t have to talk about it any more. God gave women a drive to talk to keep men from being alone, a woman’s drive to talk to a man is as strong as his drive to take her. There are many reasons why God gave women a drive to talk, let’s just say that a woman’s drive to talk is of God and that listening to her talk bores most men. You can explain that a man wants to take his wife five times before breakfast and then he’ll be back for lunch, I Corinthians 7:5 says it’s fraud if she doesn’t. God is just, a man reaps what he sows. Sanctification of Wives God commands husbands to know their wives well enough to set them apart, especially in bed: For this is the will of God, even your sanctification, that ye should abstain from fornication: that every one of you should know how to possess his vessel in sanctification and honor; God wants children to have fathers, one way to help children have fathers is to design women so that a woman clings to the man who takes her. The Song of Solomon teaches that a wife should rejoice in being God’s gift to her husband, but the husband has to treat her as God expects or he loses the blessing. Loving as Christ the Church Besides praise, listening, and sanctification, God also tells men to love their wives: Husbands, love your wives, even as Christ also loved the church, and gave himself for it; God expects men to decide to care for their wives as Christ cares for the church. Although it’s a man’s duty to die for his wife if the occasion requires, Christ generally calls a man to live for his wife. but let it be the hidden man of the heart, in that which is not corruptible, even the ornament of a meek and quiet spirit, which is in the sight of God of great price. For after this manner in the old time the holy women also, who trusted in God, adorned themselves, being in subjection unto their own husbands: even as Sara obeyed Abraham, calling him lord: whose daughters ye are, as long as ye do well, and are not afraid with any amazement. I reminded them that God gave them wombs in which He plans to form children who will come forth from their bodies in the image of God. The Bible says that God created men and women in His image, but young ladies don’t seem to think of their babies as being born in the image of God. How Marriage Works Here’s a one-verse summary of how God planned that marriage should work: And Isaac brought her into his mother Sarah’s tent, and took Rebekah, and she became his wife; A wife has to know her husband’s love to be able to comfort him, the only way she can know his love is for him to choose to be eager to talk to her enough to get to know her well enough to praise her and sanctify her. God planned that marriage should bring joy, but you must do it God’s way. Marriage prospers when a man treats his wife as God’s precious gift to him and she acts like God’s precious gift to him, marriage prospers when both parties thank each other and praise each other and appreciate each other as they thank and praise and appreciate God.

Hard-Boiled Poker: 2007 WSOP, Day 47: Part Two — Looking Ahead to the 2007 WSOP ME Final Table

Array-ne Health Care Lie: ‘47 Million Uninsured Americans’Michael Moore, politicians and the media use inflated numbers of those without health insurance to promote universal coverage. Seymour Business & Media Institute7/18/2007 4:01:33 PM Fact Sheet about Michael Moore Michael Moore was wrong about health insurance. But there are millions of people who should be excluded from that tally, including: those who aren’t American citizens, people who can afford their own insurance, and people who already qualify for government coverage but haven’t signed up. Government statistics also show 45 percent of those without insurance will have insurance again within four months after job transitions. that favored the socialist health care systems of Canada, Britain, France and Cuba, Michael Moore made the fantastic claim that almost 50 million Americans are uninsured. Subtracting the 10 million non-Americans, the number of uninsured Americans falls to roughly 37 million. “And when you’ve got 47 million people in this country with no health insurance, they don’t go to the doctor because they can’t afford it,” “The number of Americans with no health insurance is continuing to grow as more and more employers say they can’t afford to offer group insurance … But according to the same Census report, there are 8.3 million uninsured people who make between 0,000 and 4,999 per year and 8.74 million who make more than 5,000 a year. A Lie that Promotes Big Government Moore, Clinton and Obama have used the lie about 40-some million uninsured Americans to promote universal health insurance plans. The Kaiser Family Foundation, a liberal non-profit frequently quoted by the media, puts the number of uninsured Americans who do not qualify for current government programs and make less than 0,000 a year between 13.9 million and 8.2 million.

Americans ‘lied to’ about ‘47 million uninsured’Bush, Hillary, Michael Moore said to greatly exaggerate stats on health care——————————————————————————–Posted: July 19, 2007© 2007 WorldNetDaily.com President Bush, Hillary Clinton, Michael Moore and much of the mainstream media are incorrect when they claim the number of Americans without health insurance to be 40 to 50 million, with the actual number possibly under 10 million. So says the Business and Media Institute, a Virginia-based division of the Media Research Center, a nonprofit watchdog organization designed to bring balance and responsibility to the media. The actual total is open to debate, says BMI analyst Julia Seymour. But there are millions of people who should be excluded from that [high] tally, including: those who arent American citizens, people who can afford their own insurance, and people who already qualify for government coverage but havent signed up. She notes government statistics also show 45 percent of people without insurance are not completely in dire straits, as they’ll have coverage again within four months after switching jobs. Accounting for all those factors, one prominent study places the total for the long-term uninsured as low as 8.2 million

Had to bolt to get to work early and then took the work van back here to go check on the dogs. Yes, as I said before I am an 8 year-old.Work was work. I think my charm made some people smile, but we are a bunch of people working on a Sunday. Somewhere after getting my car windshield replaced and catching a movie with a friend.I walked through Target and Wal-mart today. Gotta find a way to recover during my work days.

There was a time when I had best friends. When I had friends that were like sisters to me. I was invited to a beach house to stay with friends. When my friend and I got there the other girls who were there clearly didn’t want us there. I think the thing that hurt me most was that the friend I was with did not assist me in chewing out the other people and the person who invited us did not defend us for being there. Normally I would have felt bad but I felt satisfied. After that I made sure a situation like that would never happen again. Everything I was doing was to have something to fight back with…when (not if) a friend betrayed me. Then year after year I would be friends with women for 1-2 years and then something would happen, we would fight and I would leave/disappear.

Here are the chip counts heading into play today:I believe they are very close to the end of Level 30 — there might be a couple of hands left at that level. However, I am going to venture one prediction: Lee Watkinson will begin the night in an aggressive mode, and the degree to which he is successful early on will have a big influence on how the final table plays out. Play was very tentative, with players routinely folding to relatively small preflop raises. John “Falstaff” Hartness summarized Watkinson’s bubble play for PokerNews:“Lee Watkinson had a big stack as hand-for-hand play began, and he used it to bully his opponents and increase his lead over his table. With eight short stacks surrounding him, Watkinson raised blind to 150,000 every hand, forcing players clinging to chips near the bubble to go all-in to call him. Watkinson did this all fifteen hands of hand-for-hand play, putting on a textbook display of big-stack bubble play.”When interviewed on Expert Insight this week (the Day 41 episode), Watkinson said he actually increased his preflop raises as bubble play wore on. I’m taking this display as evidence that Watkinson will be playing with relatively less fear than his opponents tonight. One or more of them could play back at Watkinson with some reraises.Like I said, PokerNews is the place to go for live reports from the final table — particularly if you aren’t shelling out the 9.95 to watch ESPN’s coverage.

China Tripping: Ch 29: Leaving YangShuo

October 3rd, 2008 by admin

Array He suggested what I was kind of thinking of anyway – that I camp at the wayside and ride in the morning when the wind died down. (It worked out fine – the worst that happened was some kids on shrooms stopped in the middle of the night and woke me up.)My goal for tomorrow is Boulder – something like 60-70 miles away with no big climbs, some of it on pavement. Today started out great – rolled out to an easy breeze at 6 AM, hung out at a place called Sixth Crossing with some Mormons about 20 miles in, and hit my turnoff back toward the route (WY 28) before noon. After 20 miles straight up – the last five into the wind, which started picking up around 1 – I was dead beat, with nowhere to camp.
link

It was a nice grade at the bottom, but toward the top it turned to singletrack where you had to get off and pull over trees, rocks, and rockslide residue. It wasn’t that I thought the turn wasn’t the one – I just never saw it at all. Then I got back on the route, got about 10 miles in, and made another wrong turn. This was partly because the map directions were going the other way and the turn was obvious from the other way, so they weren’t clear about the turn.

August 4, Day 30 (39)Good news.My blood counts have been doing so well over the last couple days that the doctors have decided to move me to the village… TODAY. The village is a small cluster of outpatientbungalows located on campus. The rooms are by no means fancy… more like a medicallythemed Hotel 6, but at least we will be out of the busy main building. It is quieter, hasmore privacy and each unit has its own kitchenette. The nurses keep on reiterating Youre not out of the woods yet” and then follow with a laundry list of things to avoid (like sunlight), symptoms to watch out for (like a cough) andmedications that are essential. Supposedly if I forget to take two pills in particular, I wont survive more than 24 hours. The hospital staff goes on to say that if complications, infections or rejection were to occur, it would most likely haqppen in the next 6 months, but more likely in the next 70 days. No champagne popping yet but things are looking good so far. Think good thoughts. The staff here says that my recovery had been remarkable. I attribute it to all the prayers and good vibes that are whizzing through the air. Thank you so much for the continued prayers and for being with me every step of the way. Medicine can treat, but it is love that heals.love,Christine

-ne Brothers Robert and Terrence Edwards scored fourth-quarter touchdowns as the Montreal Alouettes tightened the race in the CFL East Division with a 41-18 victory over the Ottawa Renegades on Friday night. The result — in what Ottawa coach Joe Paopao this week called the most important game in his team’s four-year history — left both clubs with 5-5 records, tied for second place behind the 6-3 Toronto Argonauts. It also evened the season series between the teams at 1-1, with the rubber match set for Oct. 28 in Ottawa. Before the Alouettes’ 60th straight sellout crowd of 20,202, Robert Edwards scored on a 17-yard run early in the fourth quarter and Kerry Watkins caught a 33-yard TD pass from Anthony Calvillo to put Montreal up by 23 points at 33-10.In their previous meeting July 1 in Ottawa, the Alouettes wasted a 23-point lead in the final quarter and lost in overtime, but this time, the defence held up.Josh Ranek scored on a nine-yard run for Ottawa with 1:07 remaining and Pat Woodcock made the catch for a two-point convert. But the ensuing short kickoff backfired as Terrence Edwards ran it back 49 yards for a TD — marking the first time in Alouettes history two brothers scored TDs in the same game.

Individuals calling the DOE to ask about the Striving Readers Grant got a voice mail message saying that the voice mail was full.Katherine Doherty at the DOE admitted to individuals at one school district that many districts had difficulty meeting the deadline because of computer glitches, although apparently she claimed the glitches did not originate at the DOE end. And, of course, districts applying for the Striving Readers Grant would not be districts that had the strongest technology infrastructure.Seems like the Department of Ed has once again left people behind, not only in its failure to address the realities of on-line grant submissions, but in meeting the needs of districts attempting to get clarification on the grant requirements. And their questions went unanswered weeks before the grant deadline because the DOE couldn’t handle the calls.Announcements about the Striving Readers grant recipients should be coming out in a few weeks.

Allowing the aggrieved parties to engage in whatever means necessary to resolve their conflict is not some privilege we can grant. Not surprising, when one considers that the typical Palestinian/Israeli confrontation finds rocks and bottles pitted against automatic weapons.Westerners have become the targets of terrorism because their governments have supported Israel unconditionally, without regard to the problems of the Palestinians. Being wrong is not an option, so admitting the fact is less of an option. While Westerners can deplore their methods, honesty dictates admitting the just cause of the perpetrators. Not a fitting posture for a people who were rescued from total destruction themselves only 60 years ago.It is not the right of the United States to decide which nations may exist and which may not. The U.S. government has taken to throwing its weight around with such abandon that one wonders why we have not been the target of more terrorism. Until Israel is stripped of its sacred cow status in U.S. foreign policy, little will change, except that eventually, countries that are less afraid of the truth will cease supporting us, and we will find ourselves alone with Israel facing a hostile world.

Indeed her only credential is that she has a cousin who is a junior partner in the publishing house of Newsham and Otley, although as they are, if not a vanity house, a house with more self-regard than any reputation for publishing romances, this hardly qualifies her to represent Miss Marlow. I can only assume that Phoebe had somehow discovered Miss Battersby’s propensity to hit the gin pail and assumed that she must be Miss Snark.Given Miss Battersby’s lack of experience, qualifications and indeed any sign of innate ability, it is hardly surprising that her first and only move is to attempt to place The Lost Heir with Newsham and Otley. What Miss Battersby might have gained from this contract is unclear, much like the gin in which she would almost have certainly invested it.Luckily Miss Marlow must by this stage have read a few how-to books, and while she does not go as far as sacking her agent she does manage to secure an advance (payable through her agent, who thus ensures that she can keep herself in mothers’ ruin for a little while longer), although had she read beyond the blurbs on the back she might have noticed that her contract apparently gave her no royalties nor a two book deal, nor any clarity on translation or theatrical adaptation rights. Somehow Phoebe survives all this, and even ends up marrying her Duke (although with little sign of the PR spin from such an event contributing to her sales figures), but it seems to have been a somewhat fraught and conflict-ridden exercise throughout.Surely it would have been so much more sensible for Miss Marlow to have simply written a killer synopsis and taken her chances in the Minerva Press slush pile?Technorati Tags: heyeroines

We don’t have as many trend setters, influencing the next big thing to move out to the suburbs and the provinces (though given that Detroit proper is about 85% African American, there out to be some trend we can start :) ) .But then again, Detroit is just like 90% of the US that aren’t aware of the latest trends. If anything, the brands that seem to be the most enduring have enduring product or internal (corporate) cultural trends that are so fundemental to life (regardless of trends), that they are always relevant. _ Greetings from the soon-to-not-be-sunny South where Women’s Basketball is front page news this weekend and none of it has to do with a certain national collegiate power who calls this town home and is heavy on the color orange.Hint: The university band is fond of a particular number known as “Rocky Top.”When we’re through, Jonathan Tannenwald will be checking in from up North with a report on Friday night’s WNBA game in Washington between the host Mystics and defending champion Seattle Storm. This also will complete a unique cycle of him now providing reports both North and South of our location on nights two things are worthy of your attention. We’re down here this weekend for the annual Women’s Basketball Hall of Fame induction ceremony, which is Saturday night.Six individuals will bring the overall total of inductees to 85 since the 0 million facility opened its door in 1999 on a bluff overlooking the Tennessee River. The newest honorees are former Auburn coach Joe Ciampi, former scoring sensation Lynette Woodard, former NAIA all-American Kelli Litsch, former successful high school coach Edna Tarbutton, former AAU star Dixie Woodall, and former Kodak executive Hunter Low, who helped launch the women’s basketball all-America program in 1975.The six honorees this weekend took a tour of the Hall on Friday and were available for interviews. The buffet meal included crushed corn, chicken sections, corn bread, salad, and a sundae with a choice of various accompaniments. The theme of the weekend is “welcome to our family,” and throughout the hall were pictures of the inductees and their individual “trees.”Saturday night’s ceremony will include video presentations by someone associate with each individual and curiosity is building over what former Philadelphia 76ers and Auburn star Charles Barkley, a longtime friend, will say about Ciampi.Several former members of the famed Harlem Globetrotters are here to support Woodard, a University of Kansas star who was the first woman to play for the team. They credited her during the storytelling session for “saving” the Globetrotters at a time interest had dwindled somewhat towards the team’s wild antics.Woodard was reminded this was her induction was the second in less than a year after being honored last fall in Springfield, Mass., at the Naismith Basketball Hall of Fame.Thats pretty cool, now that Ive been reminded of that, Woodard said.Sue Donohoe, the head of the women’s basketball sector of the NCAA, is among the notables here.Saturday’s print edition of our coverage, which is also in the sports’ section of Philly.Com provides some more details. After Friday’s events, we hit one of the local sports bars in the ritzy West End with our colleague Dan Fleser, who is the Tennessee women’s beat writer of the News Sentinel. It was halfway through some outstanding brisket that we felt a pulse out of our blackberry with Jonathan checking in with coverage of the Mystics game against the storm. Now that we are back in our hotel room with the ability to pull all the information together, here’s Jonathan from D.C. “I think it broke our spirit more than anything.”The Mystics’ spirit was quite different.“We needed this win desperately,” Mystics coach Adubato said, not least because the Mystics have to head almost straight to the airport for a Saturday night game at Minnesota.Washington’s last win came against the Lynx exactly a week ago, also at the MCI Center. That game ended 74-71, and although this game had a much wider margin of victory it was not so for much of the time.

I am not sufficiently familiar with US commerce clause case-law to really offer a comparative EU/US analysis, but as a stepping stone for those who want to make the actual comparison, here is an overview of ECJ case-law which is likely to be of interest…Under EU law, a scheme that would only permit national wineries to directly ship alcohol to consumers but would limit other wineries to do so would be seen as a restriction of a ‘selling arrangement’ which does not ‘affect in the same manner … the marketing of domestic products and of those from other Member States’ (C-267/91 and C-268/91 Keck and Mithouard, §16). Even so, the ECJ held the Austrian rule to be a discriminatory hindrance to intra-Community trade, because it impeded market access for products from other Member States more than it impeded market access for domestic products (§ 29).Another judgment worth mentioning – one from the pre-Keck era – is the one in Gyselinx (87 and 88/85) about the sales of medicinal products in Luxembourg. Here too the rule in principle applied to any supplier, whether national or foreign, but the ECJ held that it ‘in fact penalize[d]’ traders from other Member States (§16).Deutscher Apothekerverband (C-322/01) concerned German legislation prohibiting the direct sale of medicines by pharmacies over the internet. Again, the prohibition affected German and other pharmacies, but the ECJ held that it had a greater impact on pharmacies from other Member States, because ‘for pharmacies not established in Germany, the internet provides a more significant way to gain direct access to the German market’ (§74).Restrictions on sales channels or sales methods aren’t always considered more burdensome for ‘out-of-state’ traders who seek market access than for national traders. It has been left for the national court to assess if the law affects the marketing of Belgian periodicals to a lesser degree than the marketing of periodicals from other Member States, but the ECJ – unlike AG Léger – did not seem very convinced. The ECJ assessed the rules on import licensing under Article 28 EC and the rules on the functioning of the retail monopoly under Article 31 EC.
